These Terms of Use (“Terms”) govern your use of aivolux.tech (the “Website”), operated by Aivolux Technologies (registration no. JM1051832-K) (“Aivolux”, “we”, “us”, “our”), a business registered in Malaysia. If you don’t agree to these Terms, please don’t use the Website.
1. Using the Website
You may use the Website for lawful purposes only. You agree not to:
- use the Website in a way that breaks any law, including the Computer Crimes Act 1997, the Communications and Multimedia Act 1998 or the Personal Data Protection Act 2010;
- try to gain unauthorised access to the Website, its servers or any connected system, or test their vulnerability without our written permission;
- introduce viruses, malware or anything harmful, or interfere with the Website’s security or performance;
- copy, scrape or harvest content or data from the Website by automated means, other than ordinary search engine indexing;
- send spam, false or misleading information, or anyone else’s personal data through our forms without their permission;
- impersonate Aivolux, our team or anyone else.
We may restrict or suspend access to the Website, or block any user, if we reasonably believe these Terms have been broken.
2. Intellectual property
The Website and its content — including text, design, graphics, code, the Aivolux name and logo — are owned by or licensed to Aivolux and are protected by the Copyright Act 1987, the Trademarks Act 2019 and other laws. You may view and share links to our pages for personal and business reference, but you may not copy, reproduce, modify, republish or commercially use our content without our written permission.
Client names, logos, screenshots and other materials shown in our case studies belong to their respective owners. They appear to illustrate work we delivered and do not mean we own them or that those clients endorse anything beyond that work.
3. Information on the Website
The content on the Website, including our journal articles, is general information about our services and our industry. It is not professional, legal, financial or technical advice for your specific situation, and you shouldn’t rely on it as such.
Descriptions of services, timelines and results are for information only and are not an offer. Any work we do for you is governed by a separate written proposal or agreement, which takes priority over anything on the Website.
4. Enquiries and project briefs
Sending us an enquiry or project brief — through Lux, our project concierge, a form or by email — does not create a contract or oblige either of us to work together. You confirm that the information you send is accurate and that you are entitled to share it. We handle it as described in our Privacy Policy.
5. Third-party links and services
The Website may link to other websites, including our clients’ sites, and uses third-party services such as hosting, fonts and content delivery networks. We don’t control those sites or services and aren’t responsible for their content, availability or privacy practices.
6. Availability and disclaimer
We work to keep the Website accurate, secure and available, but it is provided “as is” and “as available”. To the extent permitted by law, we make no warranties that it will be uninterrupted, error-free or free of harmful components, or that its content is complete or current. We may change, suspend or withdraw any part of the Website at any time.
7. Limitation of liability
To the fullest extent permitted by Malaysian law, Aivolux is not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data or goodwill, arising from your use of, or inability to use, the Website or any content on it. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including any rights you may have under the Consumer Protection Act 1999.
8. Indemnity
You agree to compensate Aivolux for any claims, losses or costs (including reasonable legal fees) arising from your misuse of the Website or your breach of these Terms.
9. Privacy
Our Privacy Policy explains how we collect, use and protect personal data, and forms part of these Terms.
10. Changes to these Terms
We may update these Terms from time to time. The updated version applies from the date shown at the top of this page, so please check it when you visit. Continuing to use the Website after a change means you accept the updated Terms.
11. General
If any part of these Terms is found to be invalid or unenforceable, the rest remains in effect. If we don’t enforce a right straight away, we haven’t given it up. These Terms are the whole agreement between you and us about your use of the Website.
12. Governing law
These Terms are governed by the laws of Malaysia. Any dispute arising from them or from your use of the Website is subject to the exclusive jurisdiction of the courts of Malaysia.
